At American Credit Systems, Inc. (“ACS”), we are sensitive to your interest in privacy, and we are committed to letting you know what information is being collected, how the information is being used, and in providing you choices in the use of the information. Each time we request identification information from you, we will explain why we are asking and how we will use your information. The online personal credit report service is provided to consumers in accordance with the Fair Credit Reporting Act.
We provide backend support to our customers (“Customers”) who wish to offer their customers (“Applicant”) credit to make purchases in their establishment (“Service”). If you are an Applicant, this Legal & Privacy Notice applies when a Customer requests that we process your Personal Information (as defined below) in order to provide them with a pre-qualification to offer you credit. Unless you consent otherwise, we initially provide the Customers with a “soft pull” report on your credit. You may request that we send the Customer a “hard inquiry” on your credit in order to kick off the underwriting process. THE REPORTS MAY INCLUDE ERRORS OR INCONSISTENCIES. WE DO NOT ACCEPT ANY LIABILITY TOWARD ANY APPLICANT OR CUSTOMER FOR ANY ERROR IN ANY CREDIT REPORT PULLED OR FOR AN APPLICANT’S FAILURE TO GET CREDIT APPROVED DUE TO ANY SUCH ERROR ON THE REPORT OR ANY ERROR BY ACS.
If you believe there is an error on your credit report, contact the credit reporting agencies (Experian, TransUnion, and Equifax) to challenge any such errors.
We accept no responsibility for any such errors.
Our Customers may collect some information that would personally identify a person (“Personal Information”) from Applicants or direct such Applicants to provide it directly to us, so that we may generate a “soft” pull of the Applicant’s credit report to determine whether they are eligible for the Customer’s credit services. If you, as the applicant for credit, request it of us, we will make a “hard inquiry” on your credit and provide to our Customer and/or their financiers in order to commence the underwriting process. In all cases, our Customer is considered the “controller” of an Applicant’s Personal Information and we process that information at their direction. We do not provide that Personal Information to any third party except where we collect non-personally identifiable information about Applicants for purposes of building generalized market research and surveys. In such cases, we do not include any Personal Information related to any of the Applicants who have applied for credit with our Customers.
Credit Seeker Information
We will not release an Applicant's personal credit report through the Service without the Applicant’s consent. Where our Customer contacts us on your behalf to run a pre-qualification check, they will authenticate your identity before giving us your information. If you use our online Service, we will provide the requested credit report directly to our Customer (without providing a copy to the requestor), and you will be given the opportunity to complete your application for credit with the Customer, who will, among other things, authenticate your identity before finalizing your application.
In order to conduct the pre-qualification credit check, we collect the following Personal Information:
In limited cases we may request your social security number (if you are not identifiable from the information listed above) or if you subsequently request that a hard inquiry is made against the credit reporting bureaus for purposes of commencing the underwriting process with our Customer (in which case we may request additional identifying information such as date of birth).
- The Applicant’s name; and
- The Applicant’s address
The Personal Information provided to us in connection with ordering an Applicant’s credit report will not be shared with any third parties except our Customer with whom the Applicant is seeking credit, our affiliates at Experian, TransUnion, and Equifax as required to gather the credit report in fulfilment of the request, as required or permitted by law, or with an Applicant’s consent. In will not be used for any other purpose.
If you have requested your credit report from the us, and you later contact us for additional services or questions related to your credit, your pertinent identifying information may be provided to the NCAC in order to facilitate your request for obtaining a free consumer file disclosure required in order for you to dispute any inaccurate information in your credit report directly with the NCAC. In such an event, any phone calls with us are likely to be recorded for purposes of quality control. We will not keep any recordings longer than necessary.
We may collect some Personal Information from our website visitors, such as your IP address and information about your device and browser. Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Service Website, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, for purposes such as calculating Service Website usage levels, helping diagnose problems with the Service Website's servers, and administering the Service Website. Collecting IP addresses is standard practice on the Internet and is done automatically by many websites. We and our service providers may also collect certain environmental variables, such as computer type (Windows or Macintosh), screen resolution, OS version, Internet browser, and Internet browser version. These environmental variables are collected by most browsers and can be used to optimize your experience on the Service Website. We will also collect certain information arising out of your use of our website or augment the data we collect with other information from other online or offline sources. We collect information you provide us through customer service correspondence and general feedback. We reserve the right to collect information about you and store it in connection with other online or offline information we may possess or obtain about you.
When you visit the Service Website, we may collect non-personal information, such as a catalog of the Service Website pages you visit. Non-personal information is generally collected through the Service Website from the following sources: server log files, environmental variables, cookies, pixel tags and other similar technologies and information that you voluntarily provide. When such information is not combined with any personal information, such information is non-personal information, as it does not personally identify you or any other user. Additionally, we may aggregate personal information in a manner such that the end-product does not personally identify you or any other user of the Service Website, for example, by using personal information to calculate the percentage of our users who have a particular telephone area code. Such aggregate information is considered non-personal information for purposes of this Policy. Non-personal information may be used to develop enhancements to the Service and other products. We may use data to make changes to our product, as deemed necessary to continue to ensure your security and privacy online.
We, our service providers, and/or non-affiliated third parties, may also use so-called "pixel tags," "web beacons," "clear GIFs" or similar means (collectively, "Pixel Tags") in connection with some Service Website pages and HTML-formatted e-mail messages to, among other things, compile aggregate statistics about Service Website usage and response rates. A Pixel Tag is an electronic image, often a single pixel (1x1) that is ordinarily not visible to Service Website visitors and may be associated with Cookies on the visitors' hard drives. Pixel Tags allow us to count users who have visited certain pages of the Service Website, to deliver branded services, to provide online advertising, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted e-mail messages, Pixel Tags can tell the sender whether and when the e-mail has been opened.
Storage Of Your Information
We do not store any Personal Information in its identifying state, but we may store it in anonymized ways necessary to perform market research.

Individuals under the age of 18 must not send any personal information to us, including but not limited to information such as name, address or email address.
